Intelligence Art — Privacy Policy

This Privacy Policy explains how Individual Entrepreneur (FOP) Sadkovskyi Vadym Anatoliiovych (Tax ID (RNOKPP) 3043518350, 41 Kanatna St., apt. 16, Odesa, 65000, Ukraine — the "Company", "we") collects and processes personal data of users of the platform https://intelligenceart.ai/ (the "Platform").

We process personal data under the Law of Ukraine "On Personal Data Protection" and, where the Platform is used from the European Economic Area, under Regulation (EU) 2016/679 (GDPR).
Language. In the event of any discrepancy, the Ukrainian version shall prevail.
1. What data we collect
1.1. Account data: email address, password (stored as a cryptographic hash — we never see it), account creation date, language and interface settings. When you sign in with Google, we receive your email address, name and profile picture from Google under its own terms.
1.2. Profile data you provide: name or nickname, avatar, description, social links, and any other information you choose to add to your profile.
1.3. Learning data: courses and digital Goods (books, guides) purchased, lesson progress, quiz results, assignments you submit and their review status, certificates issued.
1.4. Studio data: your prompts and settings, source materials you upload, generated content, Credit balance and transaction history (grants, reservations, spending, expiry).
1.5. Payment data: the amount, currency, date, status of a payment, the product and order number, the last digits and type of the payment instrument, the payment service's transaction identifier and, for card subscriptions, the payment service's token that lets us charge renewals. For cryptocurrency payments: the coin, the network, the transaction hash and the sending wallet address you declare. We do not collect or store full card numbers or CVV — they are processed by the payment services. Where you order a physical Good, the shipping name, address and phone you provide.
1.6. Technical and anti-fraud data: IP address at registration and at generation, device and browser fingerprint, operating system, access times, error logs, actions within the Platform.
1.7. Communications: your messages to support, support tickets and correspondence.
1.8. Marketing data: cookies and pixel identifiers, advertising campaign identifiers, newsletter subscription status. See the Cookie Policy.
2. Why we process it, and on what legal basis

3. Who we share data with
We do not sell personal data. We share it only with categories of recipients strictly necessary to operate the Platform:
3.1. Payment services — WayForPay and Stripe — to process card payments, renewals and refunds; they act as independent controllers under their own policies. Cryptocurrency payments are read from public blockchain networks through blockchain data providers; a transaction on a public blockchain is visible to anyone by its nature. Where a physical Good is shipped, the carrier receives your shipping details.
3.2. AI model providers — to execute your generation requests, the necessary content of the request (prompt, source materials, parameters) is transmitted to the third-party provider whose model you use. Providers may store such data under their own terms and apply their own content filters. Do not include personal or confidential data in prompts.
3.3. Advertising and analytics platforms — Meta Platforms (Meta Pixel) and Google (Google Analytics, Google Ads) — where you consent to analytics and marketing cookies; and Google, where you use Google sign-in.
3.4. Service providers acting on our instructions — hosting and cloud infrastructure providers, email delivery services, and similar processors. They act as processors under agreements requiring confidentiality and appropriate safeguards.
3.5. Authorities — where disclosure is required by law or necessary to protect rights.
4. International transfers
Our infrastructure and the services listed above may process data outside Ukraine, including in the European Union and other jurisdictions. Where data of EEA users is transferred outside the EEA, transfers rely on lawful transfer mechanisms, including the European Commission's Standard Contractual Clauses or an adequacy decision.
5. How long we keep data
- Account and profile data — while the account exists and for 3 years after its deletion, for the defence of legal claims;
- Payment and accounting records — for the periods required by the tax legislation of Ukraine (at least 3 years, and 1095 days for primary documents);
- Learning data and certificates — while the account exists (certificates are kept as proof of issuance);
- Generated content and prompts — while the account exists or until you delete them, plus a short technical period for backups;
- Anti-fraud logs — up to 12 months;
- Support correspondence — up to 3 years;
- Marketing data — until you withdraw consent.
After the applicable period, data is deleted or irreversibly anonymised.
6. Your rights
You have the right to: access your data; obtain rectification of inaccurate data; request deletion; restrict or object to processing (including profiling for anti-fraud purposes); withdraw consent at any time without affecting prior processing; receive your data in a structured format (portability); and lodge a complaint with a supervisory authority — the Ukrainian Parliament Commissioner for Human Rights (Ukraine) or your local data-protection authority (EEA).
To exercise these rights, write to support@intelligenceart.ai from the email address associated with your account. We respond within 30 calendar days.
Note: deleting your account terminates access to purchased courses, digital Goods, Subscriptions and unused Credits without compensation; accounting records are retained for the periods required by law.
7. Security
We apply technical and organisational measures: encrypted connections (TLS), password hashing, access control to administrative interfaces, isolated media storage with signed access, logging and monitoring, regular backups. No method of transmission or storage is completely secure; you are responsible for keeping your credentials confidential.
8. Children
The Platform is not intended for persons under 18. We do not knowingly process the data of children. If we learn that an account belongs to a child, we will terminate it and delete the data.
9. Automated decision-making
We do not take decisions producing legal effects on you solely by automated means. Anti-fraud and moderation systems may automatically restrict a function or a generation; you may request human review at support@intelligenceart.ai.
10. Changes
We may update this Policy; the new edition applies from its publication on the Platform. Material changes are communicated by email or by a notice on the Platform.
